These Terms & Conditions (“Terms”) govern your access to and use of the Chatzoo mobile application and associated services (“Chatzoo”, “App”), provided by Biscotte GmbH, Grafenauweg 8, 6300 Zug, Switzerland (“we”, “us”, “our”).
By accessing or using Chatzoo, you agree to these Terms. If you do not agree, you must discontinue use immediately.

Chatzoo is a software application providing AI-powered conversational tools, including text generation, image generation, and optional voice input features.
2.1 Users Under 13
Chatzoo must not be used by children under 13.
We do not knowingly collect or process data from children under 13.
2.2 Users Aged 13–17
May use the App but should not rely on AI responses for emotional support, professional guidance, or high-risk decisions.
2.3 Parents and Guardians
Parents may request data deletion on behalf of a minor (see Privacy Policy).
Chatzoo provides:

Voice input features
Multiple AI model options
Saved chats & share functionality
Content editing tools
The App is intended for informational, creative, and entertainment purposes.
Chatzoo does NOT provide or replace:
Medical advice
Legal advice
Financial advice
Professional guidance
Mental health treatment
Any regulated professional service
AI responses may be inaccurate, incomplete, biased, or inappropriate.
You should verify any information before relying on it.
Chatzoo uses third-party AI models to process user inputs.

All trademarks belong to their owners.

You may need an account to access certain features. You agree to:
Provide accurate information
Maintain the confidentiality of your credentials
Not share your account
Notify us of unauthorized use
You remain responsible for all activity under your account.
You may request account deletion at any time by contacting:
6.1 Payments
All subscription payments are handled exclusively through Apple In-App Purchases.
We do not collect or store credit card details.
6.2 Auto-Renewal
Subscriptions automatically renew unless cancelled through your Apple ID settings.
6.3 Free Trials
Details are displayed in the App.
When the trial ends, the subscription will renew automatically unless you cancel.
6.4 Refunds
Refunds must be requested from Apple, not Chatzoo.
6.5 Restore Purchases
A “Restore Purchases” button is provided as required by Apple.
You may not use Chatzoo to:
7.1 Illegal Activity
Violate any law or regulation
Promote or facilitate unlawful behaviour
Generate illegal content
7.2 Harmful or Unsafe Content
You may not attempt to generate:
Sexual content
Pornographic content
Sexual content involving a minor
Violent or graphic content
Hate speech or extremist content
Self-harm or suicide content
7.3 Technical Abuse
You may not:
Reverse engineer or decompile the App
Scrape or extract content
Circumvent rate limits
Interfere with services
Submit excessive automated queries
Bypass safety filters
7.4 Misrepresentation
You may not:
Impersonate others
Use AI responses to defraud or deceive
Use Chatzoo to build competing AI systems
We may suspend or terminate accounts that violate these rules.
Chatzoo must not be used for or relied upon in high-risk or life-critical activities, including:
Medical diagnosis or treatment
Mental health assessment
Legal, tax, or regulatory decision-making
Financial or investment decisions
Operation of vehicles or machinery
Aviation or navigation
Nuclear operations
Military or warfare systems
Critical infrastructure management
Emergency response
Any activity where error could result in harm, injury, or death
You acknowledge and agree that Chatzoo is not suitable for these contexts.
We disclaim all liability where the App is used contrary to this section.
You understand that:
AI responses may seem empathetic but are purely automated
Chatzoo does not form intentions, emotions, or relationships
You must not rely on AI for emotional or psychological support
Minors should avoid excessive use
If you experience distress, seek professional assistance
We may implement systems to limit or redirect unhealthy usage patterns.
Chatzoo includes:
Filtering of unsafe content
Prevention of sexual or violent queries
Detection of minor-involved prohibited content
Reduction of emotional dependency patterns
Parents may request:
Access
Correction
Deletion
of any data associated with a minor user.
11.1 Chatzoo IP
Biscotte GmbH owns all rights in:
The App
Branding, trademarks, logos
Design, interface, and layout
Underlying code, moderation systems, routing logic
Proprietary prompts and processing techniques
11.2 User Content
You retain ownership of your inputs.
By using Chatzoo, you grant Biscotte GmbH a limited license to:
Receive
Process
Store
Transmit
Moderate
Display
your inputs solely to operate and improve the App.
We do not train proprietary models on your personal data.
Your content may be processed by third-party AI providers to generate outputs.
We choose model providers based on:
Safety
Capability
Reliability
Cost
User settings

We may add or remove providers without notice.
To protect the App and users, we may:
Block unsafe or disallowed prompts
Restrict or warn users
Enforce rate limits
Lock abusive accounts
Apply automated and human moderation
Log misuse for safety and compliance
We may also classify or categorize user inputs to maintain platform integrity.

Continuous access
Error-free operation
Output suitability for any purpose
Use of the App is at your own risk.
To the maximum extent permitted by law:
We are not liable for indirect, incidental, consequential, or punitive damages
We are not responsible for harm caused by reliance on AI output
We disclaim liability for high-risk misuse
Our total liability is capped at the amount paid in the previous 12 months
Some jurisdictions do not allow certain limitations; your rights may vary.
We may suspend or terminate access if:
These Terms are violated
Illegal or harmful use is detected
Required by law or regulatory authorities
You may cease using the App at any time.
These Terms are governed by the laws of Switzerland.
18.1 Mandatory Arbitration
Any dispute will be resolved by binding arbitration under the Swiss Rules of International Arbitration in Zurich, Switzerland.
18.2 Language
Arbitration will be conducted in English.
18.3 Injunctive Relief
Either party may seek temporary or injunctive relief in Swiss courts.
We may update these Terms periodically.
Updates take effect immediately when posted unless otherwise required by law.
